Using Your Phone While Driving: What is the Northern Ireland Law?

The dangers of using a mobile phone while driving are well-documented. It’s a major cause of road accidents, resulting in serious injuries and fatalities. In recognition of this, the law in Northern Ireland has taken a strong stance against this dangerous practice.

What is Illegal?

It’s illegal to use a hand-held mobile phone or similar device while driving or riding a motorcycle. This includes:

  • Making or receiving calls
  • Sending or reading texts
  • Accessing the internet
  • Using apps
  • Taking photos or videos

You are also not allowed to use a hand-held phone if you’re supervising a learner driver.

Penalties for Using Your Phone While Driving

The penalties for using your phone while driving are severe. If caught, you will receive an automatic fixed penalty notice of:

  • Six penalty points
  • A £200 fine
  •

If your case goes to court, the penalties are even harsher, with a potential disqualification from driving and a maximum fine of £1,000. For bus and goods vehicle drivers, the maximum fine is £2,500.

It’s important to note that for new drivers, accumulating six penalty points within two years of passing your test will result in losing your licence. You will then need to re-take your driving test to get it back.

Hands-Free Phones: A Grey Area?

While using a hands-free phone isn’t explicitly illegal, it’s important to understand the risks. Even with a hands-free device, your attention is still divided. This can impair your ability to react to hazards on the road. If your driving is affected by using a hands-free phone, you could still be prosecuted for driving without due care and attention.

 The Importance of Focus

Driving requires full concentration. Any distraction, including using a mobile phone, increases the risk of an accident. It’s essential to prioritise safety on the road and avoid any activity that could compromise your ability to drive safely.
